[ARCHIVED] Juvenile Expungement

The Department of State Police and all law enforcement agencies within the State shall automatically expunge, on or before January 1 of each year, all juvenile law enforcement records relating to events occurring before an individual's 18th birthday if:

•    one year or more has elapsed since the date of the arrest or law enforcement interaction documented in the records.

•    no petition for delinquency or criminal charges were filed with the clerk of the circuit court relating to the arrest or law enforcement interaction documented in the records; and

•    6 months have elapsed since the date of the arrest without an additional subsequent arrest or filing of a petition for delinquency or criminal charges whether related or not to the arrest or law enforcement interaction documented in the records.

Records identifying a juvenile as a victim, witness, missing juvenile or suspect of a traffic, county, or municipal ordinance violation are not included for automatic expungement. 

Juveniles who have met the above requirements who had contact with the DeKalb Police Department between January 1, 2013 and December 31, 2017, will have their records expunged prior to January 1st. 

If you would like to know what reports, if any, remain on file at the DeKalb Police Department, you may request a local check by coming to the Department, in person, during normal business hours or by completing a Freedom of Information Act Request.
